These Terms of Service ("Terms") govern your access to and use of BuildGen CRM, a software-as-a-service platform operated by The Moulton Group ("we," "us," or "our"), a company incorporated in Ontario, Canada. By creating an account or using the Service you agree to be bound by these Terms.
BuildGen CRM provides CRM, estimating, quoting, lead-tracking, and trade-coordination tools designed for building-industry professionals including building supply dealers, general contractors, and trade contractors. Features available to you depend on your subscription plan.
You must be at least 18 years of age and have the authority to bind the organization on whose behalf you register. The Service is intended for commercial use within Canada.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@buildgencrm.ca if you suspect unauthorized access.
Each organization account is isolated — your data is never visible to other organizations.

Some features of the Service require a paid subscription. Pricing is as described on the pricing page at the time you subscribe. Fees are charged in Canadian dollars and are non-refundable except as required by applicable law.
We reserve the right to change pricing with 30 days' notice. Continued use after a price change takes effect constitutes acceptance of the new pricing.
You retain ownership of all data you input into the Service ("Your Data"). You grant us a limited licence to process Your Data solely to provide and improve the Service. We will not sell Your Data to third parties.
Each party agrees to keep the other's confidential information confidential using at least the same degree of care it uses to protect its own confidential information, and not to disclose it to third parties without prior written consent.
The Service, including all software, designs, and content we create, is owned by The Moulton Group and protected by Canadian and international intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand elements.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.
Any AI-assisted features (such as lead summaries or estimate suggestions) are provided for informational purposes only and should not be relied upon as professional or legal advice.
To the maximum extent permitted by applicable law, The Moulton Group and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under or related to these Terms will not exceed the greater of (a) the fees you paid us in the three months preceding the claim or (b) CAD $100.
You agree to indemnify and hold harmless The Moulton Group and its affiliates from any claim, damage, or expense (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.
Either party may terminate your account at any time. We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms or applicable law. Upon termination, your right to use the Service ceases. We will make Your Data available for export for 30 days following termination, after which it may be deleted.
We may update these Terms from time to time. We will provide notice of material changes by email or via an in-app notice at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising under these Terms will be resolved exclusively in the courts of Ontario, and you consent to the personal jurisdiction of those courts.
